1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the services, software and websites provided by Market My Business Buzzilla Marketing (“Buzzilla Marketing”, “we”, “us”, or “our”), including the CRM, marketing automation, website and funnel builder, AI tools, reputation management, and related services we provide through the Go High Level platform and other systems (collectively, the “Services”).​

By creating an account, signing a proposal, or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Services.

2. Eligibility and Accounts

You must be at least 18 years old and have authority to bind the business or organisation you represent.

You are responsible for all activity that occurs under your account, including actions taken by employees, contractors, and other users you invite.

You must keep your login credentials secure and notify us immediately of any unauthorised access or security breach.

3. Services We Provide

We provide a white‑labelled marketing and CRM platform, powered in part by Go High Level and other third‑party tools, which may include:​

Centralised CRM and pipeline management

Website, landing page and funnel building

Marketing automation, email and SMS campaigns

Call tracking, call forwarding and missed‑call text‑back

AI chatbots and automation features

Online booking, calendar, and appointment reminders

Review and reputation management

Social media tools and related marketing services

Specific features and inclusions are described in your plan, proposal or onboarding documentation. We may update, improve, add or remove features from time to time.

4. Relationship with Go High Level and Other Providers

Buzzilla Marketing is an independent agency and reseller that uses the Go High Level platform and other tools to deliver Services to you.

We are not Go High Level and do not represent or act on behalf of Go High Level.

You agree that all support, billing questions, and disputes relating to your subscription with us will be handled directly with Buzzilla Marketing, not with Go High Level.​

Some components of the Services are subject to the third‑party provider’s own terms of service and policies. You agree to comply with those terms where applicable.

5. Your Responsibilities and Acceptable Use

You agree to:

Provide accurate information to us and keep your account details up to date.

Use the Services only for lawful business purposes and in accordance with these Terms.

Obtain all necessary consents and permissions from your contacts and customers for communications (including email, SMS, phone calls, and messaging).​

You must not:

Send spam or unsolicited messages in violation of any spam, privacy, or telecommunications laws (including, where applicable, NZ Unsolicited Electronic Messages Act and similar laws).

Upload or transmit any content that is illegal, harmful, defamatory, infringing, or otherwise objectionable.

Attempt to breach or circumvent security features, reverse engineer the platform, or interfere with other users’ use of the Services.

Misrepresent yourself as Go High Level or any other platform provider.​

We reserve the right to suspend or terminate your access if we reasonably believe you are violating these Terms or applicable law.

6. Setup, Onboarding and Done‑For‑You Work

Depending on your plan, we may provide setup, onboarding, strategy, and done‑for‑you services (such as funnel builds, automations, copy templates, or integrations).

Unless otherwise stated in a written agreement, all such work is provided on a “best efforts” and “as is” basis and does not include ongoing edits or unlimited revisions. Deliverables are licensed to you for use in your own business but remain our intellectual property unless assigned to you in writing.

7. Fees, Billing and Renewals

Our Services are provided on a subscription basis (monthly or annual) and/or project‑based fees as described in your plan, proposal, or checkout page.

By subscribing, you authorise us to charge your nominated payment method for the applicable Fees on a recurring basis until you cancel in accordance with these Terms.

Subscription fees are payable in advance and may include usage‑based or add‑on charges.

Failure to use the Services, log in, or implement recommended strategies does not relieve you of your payment obligations.

We may adjust pricing for new billing periods; if we do, we will notify you in advance via email or inside the app.

8. Cancellations

You may cancel your subscription at any time by:

Submitting a cancellation request via email to [your support email] or

Using the in‑app cancellation option (if available).

Cancellations take effect at the end of your current billing period unless otherwise stated. You remain responsible for all Fees incurred up to the effective cancellation date.

We may cancel or suspend your access for non‑payment, misuse, or breach of these Terms. In such cases, we are not obliged to provide any refund.

9. No Guarantees of Results

Marketing and lead generation outcomes depend on many factors outside our control, including your industry, offer, sales process, and market conditions.

We do not guarantee any specific business outcomes, revenue, profit, lead volume, rankings, or performance results from using the Services.

10. Data and Access on Termination

You own your customer data and content that you input into the platform (such as contact lists, messages, funnels and campaigns), subject to third‑party terms.

Upon cancellation or termination:

Your account may be disabled at the end of the paid term.

We may retain or delete your data according to our data retention practices and legal obligations.

You are responsible for exporting any data you wish to keep before your subscription ends. Once access is removed, your data may not be recoverable.

11. Intellectual Property

All software, templates, designs, workflows, documentation and other materials we provide (excluding your own content and customer data) are owned by us or our licensors.

You receive a limited, non‑exclusive, non‑transferable licence to use these materials solely for your own internal business purposes while you have an active subscription. You must not copy, resell, distribute, or share our intellectual property outside your organisation without our written consent.

12. Confidentiality

Each party agrees to keep confidential any non‑public information received from the other party in connection with the Services and to use such information only for purposes of performing under these Terms, except where disclosure is required by law.

13. Disclaimers

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

14. Limitation of Liability

To the fullest extent permitted by law:

Our total aggregate liability arising out of or relating to the Services or these Terms is limited to the Fees you have paid to us in the three (3) months immediately preceding the event giving rise to the claim.

We are not liable for any indirect, consequential, special or punitive damages, or for loss of profits, revenue, data, or business opportunities.

Nothing in these Terms limits liability that cannot be excluded under applicable law.

15. Indemnity

You agree to indemnify and hold harmless Buzzilla Marketing, its directors, employees, contractors and partners from any claim, loss, damage, cost or expense (including reasonable legal fees) arising from:

Your use of the Services,

Your breach of these Terms, or

Your violation of any third‑party rights or applicable laws (including spam, privacy and consumer laws).

16. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and may provide additional notice (e.g. by email or in‑app).

Continued use of the Services after the effective date of updated Terms constitutes your acceptance of the changes.​

17. Governing Law and Disputes

These Terms are governed by the laws of New Zealand (or insert your preferred jurisdiction).

Any disputes shall first be attempted to be resolved in good faith between the parties. If not resolved, disputes are subject to the non‑exclusive jurisdiction of the courts of New Zealand.
